PATIENT TERMS AND CONDITIONS FOR USING MyChart®

MyChart provides direct on-line access to your medical information. It provides a method to review your medical information and communicate with your health care providers, to schedule appointments, receive appointment reminders, request prescription refills, and ask questions. Because your health is important, we want you to understand how MyChart functions, and how it is utilized. We want you to be aware of what MyChart can do and what it cannot do. Therefore we ask that you read the following Terms and Conditions of access to MyChart and that you verify your understanding of those terms and conditions.

Emergencies and Urgent Conditions.  MyChart is not designed for urgent or emergency medical needs. If you have a medical emergency you should dial 911 or go to the emergency room at your local hospital. If you have an urgent condition that you do not consider a medical emergency, you should immediately contact your physician’s office by telephone. When you make a MyChart request, it may take some time for that request to be processed. You should not expect an immediate response.

ID and Password.  When you first access MyChart, you will be asked to provide a MyChart ID, a password and a password hint. Your access credentials (MyChart ID, password and password hint) are your responsibility. Do not share your access credentials with anyone and keep them confidential. If you share your access credentials, we cannot protect the privacy of your health information.

E-Mail. To activate your access to MyChart you will need to provide a current email address. If your email address changes you must notify MyChart. If other individuals use your email account or have access to your email account, they will be able to view emails and information that you send to us and that we send to you. For example, appointment reminders will be emailed to the email address you provide.

Notifications. MyChart users will be notified of appointment reminders and other medical information such as laboratory results through MyChart. The information to be provided to you through MyChart may vary from physician to physician. It is your responsibility to check MyChart for these communications. It is also your responsibility to set email filters so MyChart communications are not deleted or segregated as spam.

Communications. MyChart should not be used for any unlawful purpose or in an inappropriate manner. User must not (1) upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information; (2) misrepresent his or her identity or impersonate another person; (3) upload data that contains viruses, Trojan horses, worms, corrupted material, or any file or program that may damage the operation of the system, (4) or upload or utilize material that is protected by the intellectual property laws. MyChart and its website content are copyrighted and may not be reproduced in any manner. This includes content owned and controlled by Stormont-Vail HealthCare and content owned, controlled, and produced by MyChart or other parties.

Availability. There are times when MyChart may not be available due to system maintenance, system failure, back up procedures, or other causes beyond the control of Stormont-Vail HealthCare. Your access is provided on an as-is or as-available basis. Stormont-Vail HealthCare does not guarantee availability at all times. Stormont-Vail HealthCare does not offer any technical support in connection with your use of MyChart.

Health Information Contained in MyChart. MyChart is not a complete health record; rather it reflects selected portions of your health record. Your communications with your health care providers through MyChart will become part of your health records. Utilization of MyChart should never substitute for communications with your health care providers and questions should be addressed with your treating professionals.

Modifications. We may, at any time change these terms and conditions without advance notice to you. Your use of MyChart following any such change constitutes your agreement to follow and be bound by the modified terms and conditions.

Privacy. To understand how Stormont-Vail HealthCare keeps your health information private and to understand your rights please review the Notice of Privacy Practices which is on our website Stormontvail.org. Although Stormont-Vail HealthCare uses encryption software and other security mechanisms, no system can guarantee protection against intentional intrusion or inadvertent disclosure of protected health information because the means of transmission is beyond the control of Stormont-Vail HealthCare. The ability to access MyChart is not a request for access under HIPAA. As outlined in the Notice of Privacy Practices, you may request a paper copy or a summary of your medical record in accordance with the procedures outlined in the Notice.

Liability and Warranties. MyChart Users assume the risk of unauthorized disclosures, intentional intrusions, delay, failure or corruption of data associated with the use of MyChart. Stormont-Vail HealthCare takes no responsibility for and disclaims any liability from any inaccuracies or defects in software, communications, communication lines, VPN, ISP, the internet, access system, computer hardware or any other service or device used to access MyChart. MY CHART IS PROVIDED “AS IS” AND STORMONT-VAIL HEALTHCARE DOES NOT PROVIDE ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY OR COMPLETENESS FOR ANY OF THE COMMUNICATIONS OR SERVICES WHICH ARE USED AT YOUR OWN RISK. Stormont-Vail HealthCare is not liable or responsible for the access to or content of any linked material to or from, postings on, or content of MyChart. Stormont-Vail HealthCare will not be responsible or liable for any direct, indirect, incidental, special, exemplary, or consequential damages however MyChart is used. Stormont-Vail HealthCare will not be liable on any theory of liability including contract, strict liability, or tort (including negligence or intentional torts) arising in any way out of the use of MyChart. MyChart may contain links to other sites that are beyond the control of Stormont-Vail HealthCare; and it is not responsible for the content of such sites and does not endorse any linked site. By using MyChart you agree that all disputes will be subject to the sole jurisdiction of the District Court of Shawnee County, Kansas and that all disputes will be governed by the laws of the State of Kansas.

Termination. Stormont-Vail HealthCare has granted a limited license to use MyChart to you. You may not reproduce duplicate, sell, or make any other type of personal or commercial use of My Chart. Stormont-Vail HealthCare may terminate your access to MyChart at any time and for any reason. You may also terminate your use of MyChart by providing written notice to Stormont-Vail HealthCare. You must allow a reasonable amount of time for your request for termination to be processed by Stormont-Vail HealthCare.

Controlling Law. This Agreement will be subject to and controlled by the laws of the State of Kansas except as preempted by Federal law.
